Products identified as “Race Use Only” are designed and manufactured for racing, competitive sporting applications or, in any event, for use on closed courses, and are not intended for use on public roads, areas open to public traffic or in any other context in which the vehicle is required to comply with applicable type-approval requirements.

 

The installation and/or use of “Race Use Only” products may affect the vehicle’s original technical characteristics and may, depending on the product, the vehicle and the laws applicable in the country of use, alter emissions, noise levels, performance or other parameters relevant to type approval, road use or compliance with applicable environmental and safety requirements, including, by way of example, requirements administered by the U.S. Environmental Protection Agency (“EPA”) and the California Air Resources Board (“CARB”), Regulation (EU) No 168/2013 and applicable UNECE Regulations.

 

Before purchasing, installing or using the product, the User is responsible for verifying the product’s compatibility with the vehicle, the intended use of the product and compliance with all laws and regulations applicable in the country in which the product and/or the vehicle will be used.

 

ATHENA shall not be liable for any use of “Race Use Only” products that is inconsistent with the instructions provided, their stated intended use, applicable laws and regulations, or the type-approval and road-use requirements in force in the country of use.

 

Incorrect installation, misuse, alteration, tampering, inadequate maintenance or failure to comply with the instructions provided by ATHENA may compromise the safety of the product, the vehicle and/or their use.

 

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT FOR ANY WARRANTIES OR LIABILITIES THAT MAY NOT LAWFULLY BE EXCLUDED OR LIMITED, “RACE USE ONLY” PRODUCTS ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR FITNESS.  TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ATHENA SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, COST, EXPENSE, PENALTY, FINE OR OTHER CONSEQUENCE ARISING OUT OF OR RELATING TO THE INSTALLATION OR USE OF A “RACE USE ONLY” PRODUCT.
